Welcome to Nomia. These Terms of Service ("Terms") govern your use of our community event and meal planning application ("Service") operated by Nomia ("us", "we", or "our").

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.

2. About Nomia

Nomia is privately owned and operated by a single individual. This means you are dealing with a small, independent business rather than a large corporation. While this allows for personalized service and direct communication, please understand that resources and support capacity are limited compared to larger organizations.

We are committed to providing reliable service and protecting your data, but as an individual operator, response times for support and feature development may vary based on availability and circumstances.

3. Description of Service

Nomia is a community platform that enables users to:

  • Create and join community groups
  • Plan and organize events and meetings
  • Coordinate meal planning and food signups
  • Communicate through messaging boards
  • Manage group directories and member information (including optional contact details and family information)
  • Share profile information within groups for community planning purposes

4. User Accounts

Age Requirements

You must be at least 13 years old to create an account and use our Service. We verify age during registration through date of birth collection. If you are under 18, you represent that you have permission from your parent or guardian to use our Service.

Account Responsibilities

When you create an account, you agree to:

  • Provide accurate, current, and complete information, including your correct date of birth
  • Maintain and update your information to keep it accurate
  • Maintain the security of your password and account
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use of your account

5. User Conduct

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Post harmful, abusive, harassing, or offensive content
  • Impersonate another person or entity
  • Share false, misleading, or deceptive information
  • Spam or send unsolicited communications
  • Attempt to gain unauthorized access to the Service
  • Upload viruses or malicious code
  • Interfere with the proper functioning of the Service
  • Share information about children without proper parental authority

Children's Information

If you choose to share information about children in your group profiles (such as names and birthdays), you represent that you are the parent or legal guardian of those children and have the authority to share such information for community planning purposes.

User-Generated Content Disclaimer

Important: Nomia does not monitor, review, or control user-generated content in real-time. We are not responsible for content posted by users, including but not limited to messages, comments, event descriptions, or any other information shared within groups.

Users are solely responsible for the content they post and share. Any views, opinions, advice, statements, services, offers, or other information expressed by users are those of the individual users and not of Nomia.

While we may remove content that violates these Terms when brought to our attention, we make no guarantee that all inappropriate content will be identified or removed promptly. Users participate in groups and view content at their own discretion and risk.

6. Content Ownership and Rights

Your Content

You retain ownership of any content you post or submit to the Service. However, by posting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content in connection with the Service.

What this means: This license is necessary for us to operate the Service and includes activities such as:

  • Displaying your messages, events, and posts to other group members
  • Storing your content on our servers and backup systems
  • Allowing group members to view and interact with your content
  • Providing technical functionality like notifications and search features

What this does NOT mean: We do not use your personal content for marketing purposes, sell it to third parties, or use it outside the context of providing the Service to you and your groups.

Group Content

Content created within groups becomes part of the group's collective content. By participating in groups and contributing content (messages, events, meetings, comments, etc.), you acknowledge that:

  • Your contributions become part of the group's shared community record
  • Group administrators have the authority to manage, moderate, and delete group content
  • Group content may remain available to group members even after you leave or delete your account
  • The group and its members benefit from the continuity of shared content and planning history

This ensures that community planning, event coordination, and group discussions remain intact for the benefit of all group members.

Our Content

The Service and its original content, features, and functionality are owned by Nomia. You may not copy, modify, distribute, or reverse engineer the Service or its underlying code without our permission.

7. Privacy

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the Service, to understand our practices.

8. Community Groups

When you create or join a community group, you acknowledge that:

  • Group administrators have the authority to manage group content and membership
  • Information shared within groups is visible to all group members
  • You are responsible for your interactions within groups
  • We may remove groups that violate these Terms

Group Creation and Administration

When you create a group or assume administrator responsibilities, you acknowledge and agree that:

  • You are responsible for managing your group in compliance with these Terms
  • You have the authority to moderate content, manage membership, and enforce group rules
  • You are responsible for the overall conduct and content within your group
  • You must promptly address any violations of these Terms within your group
  • You understand that group content will persist even if individual members leave or delete their accounts
  • You may be held accountable for harmful or illegal activities that occur in your group
  • We reserve the right to remove administrators or dissolve groups that violate these Terms

As a group administrator, you play a key role in maintaining a safe and productive community environment for all group members.

Optional Information Sharing

You may voluntarily choose to share additional information in your group profiles, including:

  • Contact information (phone number, address) for group directories
  • Family information (children's names and birthdays) for community planning

This information is entirely optional and can be updated or removed at any time through your profile settings.

9. Termination and Account Deletion

Termination by Us

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including if you breach these Terms.

Account Deletion by You

You may delete your account at any time through your account settings. Upon account deletion:

  • Your personal profile information will be removed
  • Your access to the Service will cease immediately
  • Direct references to your identity will be anonymized

Group Content Retention

Important: Content you created within groups (including but not limited to messages, events, meetings, comments, polls, and other contributions) will remain as part of the group's collective content and community record. This content belongs to the group and will continue to be available to group members.

Group content will only be removed when:

  • A group administrator manually deletes specific content
  • The entire group is deleted by a group administrator
  • We are legally required to remove specific content

This policy ensures continuity of group activities, preserves community discussions, and maintains the collaborative nature of group planning while respecting your privacy through anonymization of personal references.

10. Disclaimers

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, expressed or implied, including:

  • That the Service will be uninterrupted or error-free
  • That the Service will meet your specific requirements
  • That any defects will be corrected
  • That the Service is free from viruses or harmful components
  • That your data will be permanently preserved or always accessible

Data Backup and Responsibility

Important: While we implement security measures and backup systems to protect your data, we cannot guarantee that your content will never be lost, corrupted, or become inaccessible due to technical failures, security incidents, or other unforeseen circumstances.

You are responsible for maintaining your own backups of any content or information that is important to you. You should not store anything in the Service that you cannot afford to lose or that represents your only copy of important data.

We strongly recommend keeping local copies of important information, including contact details, event plans, and other critical content that you create or share through the Service.

11. Limitation of Liability

In no event shall Nomia be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the Service.

12. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of the State of Iowa, United States, without regard to its conflict of law provisions.

Any legal disputes arising out of or relating to these Terms or the Service must be brought exclusively in the state or federal courts located in Iowa, United States. You consent to the personal jurisdiction of such courts and waive any objection to the laying of venue in such courts.

13. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect.
